Certain photographs, videos, and other content available through Wynstock are designated "Editorial Use Only." Editorial Content is intended to illustrate newsworthy events, subjects of public interest, cultural events, entertainment, sports, business, travel, politics, public figures, historical events, and other matters where the Content is being used for genuine editorial, journalistic, documentary, educational, or informational purposes. Editorial Content is not automatically cleared for advertising, marketing, promotion, endorsement, merchandising, or other commercial uses. By licensing or using Content designated "Editorial Use Only," you agree to this Editorial Content License & Use Policy, Wynstock's Terms & Conditions, and any additional restrictions or Special Instructions associated with the individual Content.
1. Editorial Use Only
Content marked “Editorial Use Only” may be used only in a genuine editorial context. An editorial use is a use made primarily for reporting, commentary, criticism, education, documentary purposes, or to illustrate a subject that is newsworthy or of legitimate public or human interest. The Content must have a reasonable relationship to the subject matter in which it appears.
The mere fact that Content appears in an article, blog, publication, documentary, or informational page does not automatically make the use editorial. The nature and purpose of the use will determine whether it qualifies.
2. Permitted Editorial Uses
Subject to these terms and any restrictions associated with the individual Content, Editorial Content may generally be used in genuine editorial contexts including newspaper and magazine articles, news websites, editorial blogs, documentary productions, nonfiction publications, educational materials, historical materials, commentary, criticism, reporting, and similar informational publications.
Editorial Content may also be used in social-media posts or digital channels where the Content remains directly connected to the same qualifying editorial story, article, report, or publication for which it was licensed. Any use must preserve the legitimate editorial context of the Content.
3. Single Use in Context
Unless otherwise expressly stated, a Wynstock Editorial License permits one editorial use in one specific context. A “single use” means use of the Content in connection with one specific article, story, report, documentary segment, publication, feature, or other editorial project.
The same licensed use may be distributed through multiple formats or channels provided that the Content remains connected to substantially the same original editorial context. For example, an image licensed to illustrate a particular news article may also accompany that same article when it is published on the publisher's website, included in its digital edition, or promoted through the publisher's social-media channels.
Using the same image later in an unrelated article, a different story, a different editorial campaign, or another independent context constitutes a new use and requires a new license.
4. Commercial and Promotional Use Is Not Included
Editorial Content may not be used for advertising, marketing, promotion, sponsorship, endorsement, merchandising, branding, advertorials, product packaging, sales materials, or other commercial purposes unless Wynstock provides separate written authorization.
This restriction applies even where the proposed commercial use is connected to an otherwise legitimate publication or media organization. For example, an Editorial image may potentially be appropriate within a news article about a company but may not be used in an advertisement promoting that company. Similarly, Content appearing within an editorial publication does not automatically qualify for editorial use if its actual purpose is to promote a product, service, organization, event, brand, or commercial offering.
5. Commercial Licensing Requests
In certain circumstances, Wynstock may be able to investigate whether additional permissions can be obtained to allow Editorial Content to be used commercially. Commercial clearance is not guaranteed. Additional permissions, releases, licensing fees, restrictions, or approvals may be required from photographers, copyright owners, depicted individuals, trademark owners, property owners, event organizers, artists, or other rights holders.
If you are interested in using Editorial Content for advertising, marketing, promotional, merchandising, branding, sponsorship, or another commercial purpose, please contact Wynstock before using the Content.
Contact: info@wynstock.com
A request for commercial use does not grant permission. Commercial use is permitted only after Wynstock provides express written authorization describing the permitted use.
6. Model and Property Releases
Editorial Content may include recognizable individuals, celebrities, athletes, performers, public figures, private individuals, trademarks, artwork, products, buildings, privately owned locations, copyrighted designs, or other protected material. Model releases, property releases, trademark permissions, or other commercial clearances may not have been obtained for Editorial Content.
The availability of Editorial Content through Wynstock therefore does not represent or guarantee that the Content has been cleared for commercial use. The licensee is responsible for complying with any rights, permissions, or legal requirements applicable to its particular use.
7. No Implied Endorsement
Editorial Content must not be used in a manner that falsely states or implies that a depicted person, company, organization, brand, property, or rights holder endorses, sponsors, supports, uses, or is otherwise commercially associated with a product, service, company, campaign, political position, or organization. The Content must be presented in a manner consistent with its genuine editorial purpose.
8. Context and Accuracy
Editorial Content must be used accurately and in context. You may not use Editorial Content in a way that materially misrepresents the event depicted, the identity or actions of a depicted person, the location depicted, the date or circumstances of the Content, or the relationship between the Content and the accompanying story. Captions, headlines, descriptions, surrounding copy, and other context must not intentionally create a materially false or misleading impression about what the Content depicts.
9. Editing Editorial Content
Editorial Content may be subject to reasonable technical editing where the factual and editorial integrity of the original Content is maintained. Permitted adjustments may include reasonable cropping, resizing, formatting, compression, color correction, or similar technical changes necessary for publication.
You may not materially alter Editorial Content in a manner that changes the meaning, factual context, circumstances, or perceived reality of what was originally depicted. In particular, Editorial Content must not be manipulated to add or remove people, objects, products, signage, events, or other material elements where doing so would create a false or misleading representation. Creative or generative modifications that materially change the underlying scene should not be presented as authentic documentary or editorial Content.
10. Sensitive and Potentially Defamatory Uses
Editorial Content must not be used in a defamatory, deceptive, unlawful, or misleading manner. Particular care must be taken when Content is used in connection with sensitive subjects including allegations of crime, substance abuse, medical conditions, mental health, sexual activity, financial distress, political affiliation, religious beliefs, controversial conduct, or other subjects that could reasonably damage a person's reputation or imply facts that are not demonstrated by the Content itself.
The presence of a person in Editorial Content does not establish that the person is involved in, endorses, or is associated with the subject of an accompanying article.
11. Geographic Restrictions
Some Editorial Content may be subject to restrictions limiting where the Content may be published, distributed, displayed, or otherwise used. These restrictions may arise from agreements with photographers, agencies, events, rights holders, venues, leagues, entertainment organizations, or other third parties.
Any geographic restriction shown on the Content page, purchase page, license information, metadata, invoice, or Special Instructions forms part of your license and must be observed. If no geographic restriction is stated, the Content may generally be distributed worldwide as part of the specific editorial use for which it was licensed.
12. Special Instructions
Certain Editorial Content may include Special Instructions. Special Instructions may establish additional restrictions concerning geographic territory, publication type, industry, timing, embargo periods, attribution, permitted media, commercial use, event-specific restrictions, or other conditions.
You must review any Special Instructions associated with the Content before licensing or publishing it. Where Special Instructions conflict with the general terms of this Editorial Policy, the Special Instructions applicable to the specific Content will control.
Content marked Special Instructions: Editorial use only may not be used commercially unless Wynstock provides separate written authorization.
13. Credits and Attribution
Where a credit is displayed with Editorial Content, required by the applicable Content information, or customary for the relevant editorial use, the credit must be reproduced in a reasonably visible manner. Unless a different credit is specified with the Content, the credit should substantially follow the attribution information provided by Wynstock with the licensed asset.
Where photographer or contributor information is provided, a credit may appear substantially as:
[Photographer / Contributor Name] / Wynstock
Any specific credit instructions associated with an individual item of Content take precedence. You may not intentionally remove embedded copyright information or falsely identify another party as the photographer, creator, or copyright owner of the Content.
14. Publication Covers and Prominent Promotional Placement
Use of Editorial Content inside a qualifying editorial publication does not necessarily authorize the same Content to be used as advertising or promotional material for that publication. Where Editorial Content is proposed for prominent use on a book cover, magazine cover, publication cover, promotional poster, paid advertisement, marketing campaign, or similar placement that could imply endorsement or serve primarily as promotion, additional clearance may be required. Please contact Wynstock before making such use if the permitted status is unclear.
15. Social Media
Editorial Content may be published through social media where the use is connected directly to a permitted editorial story or purpose. For example, a news publisher may use Content to accompany a social-media post linking to or reporting the same story for which the Content was licensed.
Editorial Content may not be used simply as general social-media imagery for a company, brand, commercial organization, influencer campaign, promotional account, or marketing campaign.
16. Corporate and Brand Websites
The fact that a website contains articles, a blog, newsroom, or informational material does not automatically make use of Editorial Content permissible. Businesses may use Editorial Content only where the specific use is genuinely editorial and does not advertise, promote, endorse, or market the business, its products, or its services.
Content appearing on a commercial organization's homepage, product page, sales page, advertisement, promotional landing page, or marketing campaign will generally be considered commercial rather than editorial. If there is uncertainty regarding the intended use, contact Wynstock before publication.
17. Educational and Nonprofit Use
Educational, charitable, governmental, and nonprofit organizations are not automatically exempt from Editorial Content restrictions. The intended use must still qualify as editorial, educational, documentary, newsworthy, or informational. Fundraising, donor campaigns, promotional materials, sponsorship materials, recruitment advertising, merchandise, and campaigns promoting an organization's services may constitute promotional or commercial uses and may require additional permission.
18. Broadcast, Film, and Documentary Use
Editorial Content may be used within qualifying documentary, news, historical, educational, or factual productions where permitted by the applicable license and any Special Instructions. Use within entertainment programming, fictional productions, advertising, branded entertainment, sponsored productions, trailers, promotional material, or other commercially promotional contexts may require additional clearance.
Where the Content page contains medium-specific restrictions, those restrictions apply.
19. Resale and Redistribution
An Editorial License does not permit you to resell, sublicense, redistribute, share, give away, or make the original Content available as a stand-alone file. You may not:
- Provide the Content through another stock library or media library.
- Make the Content available for download by third parties.
- Include the source file in a downloadable template or asset package.
- Sublicense the Content independently of the permitted editorial project.
- Permit unrelated third parties to reuse the Content.
Employees and contractors working on the licensed editorial project may receive the Content only as reasonably necessary to complete that project and may not use it independently.
20. Artificial Intelligence and Machine Learning
Editorial Content may not be used to train, fine-tune, test, validate, benchmark, or otherwise develop artificial-intelligence or machine-learning models unless Wynstock expressly authorizes such use in writing. Editorial Content may not be contributed to an AI training dataset or otherwise made available to a system for the purpose of learning from or reproducing the Content.
Ordinary software tools that assist with permitted technical editing do not automatically violate this provision, provided the Content is not contributed for model training and the resulting use otherwise complies with this Policy.
21. Additional Rights May Be Required
A Wynstock Editorial License grants only those rights that Wynstock is authorized to license in the Content itself. Depending on the intended use, additional permissions may be required relating to recognizable people, trademarks, copyrighted artwork, buildings, private property, performances, sporting events, entertainment events, designs, brands, or other protected elements appearing within the Content. It is your responsibility to determine whether such permissions are required for your particular use. If you are uncertain, contact Wynstock before publication.
22. Availability and Withdrawal of Editorial Content
Wynstock may remove, restrict, or discontinue the licensing of Editorial Content at any time. Removal of Content does not ordinarily invalidate a properly obtained license for a previously authorized use. However, Wynstock may request that you cease future use where Wynstock reasonably believes that continued use may infringe third-party rights, violate law, breach a rights-holder agreement, or expose Wynstock or the licensee to significant legal risk.
23. Relationship to Other Wynstock Terms
This Editorial Content License & Use Policy forms part of Wynstock's licensing terms. Your use of Editorial Content is also subject to Wynstock's:
- Terms & Conditions
- Terms of Use
- Privacy Policy
and any Content-specific license terms, restrictions, or Special Instructions. Where a specific restriction associated with an individual item of Editorial Content conflicts with this general Policy, the more specific restriction will control.
24. Questions About Permitted Use
Editorial licensing can depend heavily on context. If you are unsure whether a proposed use is editorial or commercial, or if you would like to use Editorial Content for advertising, marketing, promotion, merchandising, branding, sponsorship, or another commercial purpose, contact Wynstock before using the Content.
